Privacy Policy
Effective May 5, 2026.
Binkley Toys Inc. (“we,” “us,” or “our”), operating as Custom Plush Toys at customplushtoys.com, respects your privacy and is committed to protecting your personal information in accordance with applicable laws including Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), the EU General Data Protection Regulation (GDPR), and applicable U.S. state privacy laws including those of California.
1. Overview
This policy explains what information we collect, how we use it, who we share it with, and your rights. We try to keep this plainly written. If anything is unclear, ask: rob@custom-plushtoys.com.
2. Information We Collect
We collect information when you:
- Submit a quote request through our quote tool
- Contact us via our contact form, email, or phone
- Sign a Non-Disclosure Agreement on our site
- Place a prototype deposit through our payment provider
- Apply for our scholarship by email
- Subscribe to our email list
- Visit our website (basic technical data only)
The personal information we may collect includes:
- Name and company name
- Email address and phone number
- Mailing address (for shipping orders or NDA records)
- Project details, design files, and reference images you share with us
- Quote details (size, quantity, configuration, pricing tier)
- Signature and signing-event metadata (IP address, timestamp) when you sign an NDA or other agreement
- IP address, device, and browser information collected by our hosting provider for security and operational purposes
3. How We Use Your Information
We use your information to:
- Provide quotes and communicate about your project
- Design, manufacture, and deliver products and services you order
- Maintain records of signed agreements (NDAs, Letters of Agreement)
- Send transactional emails (e.g., quote results, signed PDFs, order updates)
- Send relevant updates and marketing communications you have opted into
- Improve our website, services, and customer experience
- Comply with legal obligations and protect against fraud or abuse
4. Email Communications
We use two services to send email:
- AWeber — for marketing and educational email sequences (e.g., quote follow-ups, helpful content for inventors and corporate clients).
- Amazon Web Services (AWS) Simple Email Service — for transactional emails such as quote confirmations, signed PDFs, and order updates.
By submitting your information, you consent to receiving emails related to your inquiry, project, or order. You may unsubscribe from marketing emails at any time using the link in any marketing message. Unsubscribing does not stop transactional emails directly tied to a project or order you have placed.
5. Third-Party Services We Use
To run this website and deliver our services, we share or process data through these providers:
- Cloudways & Amazon Web Services — website hosting and email infrastructure (servers located in Canada and the United States).
- AWeber — email list management and marketing automation (United States).
- Thrivecart — payment processing for prototype deposits. Payment card information is entered directly with Thrivecart and never touches our servers.
- Vimeo — embedded video player on selected pages. Vimeo may collect playback analytics.
- Google Maps Platform — we display Google Reviews on our home page using Google’s Places service.
- Bunny Fonts and jsDelivr — content delivery networks that host fonts and JavaScript libraries used by the site. Like all CDNs, they receive your IP address when assets load.
6. Advertising & Analytics
With your consent, we use the following services to understand site traffic and reach the right audiences with our advertising:
- Google Analytics 4 — aggregated traffic and behavior analytics. We use Google Consent Mode v2; analytics storage is denied until you opt in via the cookie banner.
- Meta Pixel — ad performance measurement and audience building for Facebook and Instagram ads. The pixel only loads after you accept marketing cookies.
- AWeber — in addition to email delivery, AWeber provides limited form and engagement analytics that help us understand which content drives email signups.
You can manage your choice at any time via the “Cookie Settings” link in the site footer. See our Cookie Policy for full details on each service.
7. Cookies & Similar Technologies
We use cookies in three categories:
- Essential — session and CSRF cookies that make the site work.
- Analytics — Google Analytics, only when you opt in.
- Marketing — Meta Pixel and AWeber, only when you opt in.
A consent banner appears on your first visit. You can change your choice anytime via the “Cookie Settings” link in the footer. See our Cookie Policy for the full breakdown.
8. International Data Transfers
Your information may be processed in Canada, the United States, or other jurisdictions where our service providers operate. By using our website or doing business with us, you consent to this transfer. We use providers that maintain commercially reasonable security and follow industry-standard practices.
9. Data Retention
We retain personal information only as long as necessary to fulfill the purpose it was collected for (delivering your project, maintaining records of signed agreements), to comply with legal and tax obligations, or to support legitimate business needs. Marketing preferences are honored until you unsubscribe; underlying records (e.g., signed NDAs, completed orders) may be retained for several years thereafter for legal and operational reasons.
10. Your Rights
Depending on your location, you may have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your information (subject to legal retention requirements)
- Withdraw consent for marketing communications
- Object to specific uses of your data
- Request a copy of your data in a portable format
To exercise any of these rights, email us at rob@custom-plushtoys.com. We will respond within 30 days.
11. Children’s Privacy
Our services are intended for businesses and adults. We do not knowingly collect personal information directly from children under 13. Our products are designed for children, but the buying decisions and account interactions are made by adults. If you believe we have inadvertently collected information from a child, contact us and we will delete it.
12. Data Security
We implement reasonable technical and organizational safeguards to protect your data, including encrypted connections (HTTPS) for the entire website, encrypted password storage for any account credentials, and access controls limiting who at our company can access customer information. No system is completely secure; if we ever experience a breach affecting your information, we will notify you in accordance with applicable law.
13. Changes to This Policy
We may update this policy occasionally to reflect changes in our practices or legal requirements. The “Effective” date at the top of this page reflects the most recent change. Material changes will be communicated via email to active customers where appropriate.
